This working paper examines the constitutional validity of free entry mining regimes in Yukon and the Northwest Territories under section 35 of the Constitution Act, 1982, arguing that such regimes may be inconsistent with existing aboriginal title. The paper analyzes the 1870 Imperial Order in Council and applies Supreme Court jurisprudence to mineral disposition systems in northern Canada, drawing on case studies from Baker Lake, Lac de Gras, and Finlayson Lake.
